Definitions
“Applicant” means the person named on the Entry Form who has applied to take part in the Programme.
“Collaborative Sport Partners” means the National Governing Bodies for sports that the Organiser will be collaborating with for the Programme.
“Conditions” means these terms and conditions for the Programme.
“Entry Form” means the ‘Find Your Greatness – Sign Up Form’.
“Events” means the first stage regional performance events and the second stage individual or multi-sport testing events with the Collaborative Sports Partners.
“Organiser” means United Kingdom Sports Council (‘UK Sport’) incorporated by Royal Charter in England and Wales with number RC000765 and with its principal office at 6th Floor, 10 South Colonnade, London E14 4PU.
“Participant” means the person named in the Entry Form who has been selected by the Organiser to participate in some or all of the Events.
“Programme” means the ‘Find Your Greatness’ programme organised by UK Sport.
- Acceptance of Conditions
These Conditions shall apply in place of and prevail over any terms or conditions contained or referred to in any documentation submitted by the Applicant or in correspondence or elsewhere or implied by trade custom, practice or course of dealing. A variation of these Conditions is only valid if the Organiser gives notice to the Applicant in writing in any official material or correspondence. The Applicant shall be deemed to have accepted these Conditions upon completion of the Entry Form.
- Application Process
- In consideration for being granted the right to participate in the Programme, the online Entry Form must be completed and submitted no later than Sunday 3rd November 2024.
- The Entry Form submitted by the Applicant will be accurate, truthful and performance test results will be as precise as possible.
- The Applicant’s participation in the Programme will be subject to their application being successful. If successful, the Applicant will be contacted by the Organiser with an invitation to take part in the Programme.
- The selection decisions of the Organiser and Collaborative Sports Partners throughout the Programme will be final and not subject to appeal.
- Participation in the Events
- It is acknowledged that participation in the Events will be physically demanding, and the Participant is aware of the nature of the Events and associated medical and physical risks involved.
- The Participant agrees that they are physically capable of competing in the Events and agrees to be solely responsible for their actions. The Organiser, Collaborative Sports Partners and their officers, employees, agents, affiliates, associated companies, sponsors or medical advisers are not responsible for any injury or illness that the Participant may suffer as a result of their participation in the Events. The Participant accepts that should any medical or physical condition arise prior to the Events, which is likely to affect their ability to compete, the Participant will withdraw in accordance with these Conditions.
- The Participant must disclose on the Entry Form and keep the Organiser updated of any pre-existing medical conditions, disabilities or medication that may be relevant in the administration of any medical assistance and agrees that any medical information provided to the Organiser may be shared with the Collaborative Sports Partners and Events medical providers to best ensure their safety in the case of a medical emergency.
- The Participant is responsible for ensuring they wear suitable clothing, as directed by the Organiser and/or Collaborative Sports Partners, and that any other items required for participation in the Events have been properly maintained. Save to the extent caused by negligence on the part of the Organiser, the Participant will be entirely responsible for any injury sustained (whether to themselves or others) as a result of any reckless behaviour, failure to take proper care or pay proper attention, or failure to adhere to warning signs or instructions.
- The Organiser and/or Collaborative Sport Partners reserve the right at any time to remove the Participant and/or parents, guardians or carers and/or spectators of the Participant from the Events or prevent the Participant participating in the Events if, in the Organiser’s and/or Collaborative Sport Partners’ sole discretion, it considers such action necessary for safety reasons or the proper enjoyment of the Events by other participants or for any other reasonable reason.
- The Organiser, Collaborative Sport Partners’ and their officers, employees, agents, affiliates, associated companies, sponsors or landowners, or medical advisers are not responsible for any loss or damage to any personal items belonging to the Participant at the Events.
- On submission of the Entry Form, the parent, guardian or carer of the Participant who is a minor confirms that:
- the information provided on the Entry Form for the Participant is correct.
- the Participant is in good health and is capable of taking part in the Events.
- they consent, in the event of an emergency, that any necessary treatment can be administered to the Participant.
- they accept that whilst the Organiser, Collaborative Sport Partners and their employees, event officials, authorised agents, sub-contractors, and/or volunteers will take reasonable precautions to ensure accidents do not happen, they cannot be held responsible for any loss, damage or injury suffered by the Participant.
- All decisions and rulings by the Organiser, its employees and its agents are considered final. The Participant will comply with all rules, instructions and guidelines of the Events given by the Organiser, Collaborative Sport Partners and their employees, event officials, authorised agents, sub-contractors, and/or volunteers. The Participant acknowledges and agrees that the Organiser and Collaborative Sport Partners will organise and run the Events and will have sole authority and be the final arbiter on all decisions relating to the safety, running and organisation of the Events, the rules of the Events and the results of the Participant.
- These Conditions are personal to the Participant and it may not assign any of its rights or obligations under this Agreement without the prior written consent of the Organiser.
- The Participant consents to receiving communication from the Organiser, specifically related to the Programme, before and after the Events.
- The Participant must ensure the Organiser is notified of any changes in personal details including but not limited to their name, email, address or contact number. The Organiser cannot be held responsible for any communication correctly addressed and sent either physically or electronically (such as by way of illustration any electronic mail that is filtered as spam or rejected for any reason by the Participant’s service provider) that is not received by the intended recipient.
- Withdrawal, Cancellations or Alterations
- The Organiser and/or Collaborative Sport Partners reserve the right to cancel, delay or postpone the Events due to circumstances beyond their reasonable control (such as, by way of illustration, cancellation by the Events venue owners, an act of nature, emergency service instructions or an outbreak/epidemic of any communicable disease).
- In the event of such cancellation, delay or postponement of the Events, the Organiser and/pr Collaborative Sport Partners shall not be liable for any inconvenience, expenses, costs, losses or damages suffered by the Participant, or the parent, guardian, carer or spectator of the Participant as a result of such postponement.
- The Organiser and/or Collaborative Sport Partners reserve the right to amend the formats of the Events due to circumstances beyond their reasonable control.
- The Organiser and/or Collaborative Sport Partners reserve the right to amend the time of the Events due to circumstances beyond their reasonable control. In the event of such change, which shall be communicated as soon as reasonably practical, there shall be no further liability whatsoever arising from such change.
- Organiser Responsibilities/Liability
- Notwithstanding anything in these Conditions, the Organiser and Collaborative Sport Partners shall not be liable to the Participant for any liability in contract, tort (including negligence) or otherwise for any loss of business, revenue or profits, anticipated savings or wasted expenditure, loss or damage of or to personal equipment belonging to the Participant or any indirect or consequential loss or damage whatsoever arising out of the Participant taking part in the Events, Programme or any other matter arising under these Conditions. Without limiting the foregoing, the Organiser and Collaborative Sport Partners will not be liable for any actions of parents, guardians, carers, spectators or any other third parties unless otherwise set out herein.
- Accordingly the Participant hereby expressly and irrevocably renounces, for themself, heirs and successors in title the right to any recourse or claims whatsoever against the Organiser, Collaborative Sport Partners and their officers, employees, suppliers and/or persons for whom they are answerable (“Associated Parties”) as a result of any kind of physical, mental or other loss or damage of whatsoever nature (including any loss of earnings, profits, or pain and suffering) suffered by the Participant, directly or indirectly, or by their family or by any dependents and caused by an event in any way relating to the Participant’s participation in the Events, and the Participant hereby undertakes, for themself, heirs and successors in title to indemnify and hold harmless the Organiser, and the Associated Parties for any costs and/or amount which they or any of them may be required to pay as a result of any recourse or claim aforesaid by whomsoever made. The Participant also agrees to indemnify the Organiser and the Associated Parties for any claim, actions, liabilities or losses resulting from any breach of the Participant’s declarations above and/or the Participant’s negligent acts or omissions and/or wilful misconduct.
- Nothing in these Conditions shall exclude or limit the liability of the Organiser and the Collaborative Sport Partners:
- for death or personal injury caused by their negligence; or
- for fraud or fraudulent misrepresentation; or
- for any matter which it would be illegal for them to exclude or attempt to exclude liability.
- This clause 5 shall be read and construed and shall have effect subject to any limitation imposed by any applicable law.
- Media & Results
- The Participant consents to:
- their appearance in the Events being photographed, filmed, recorded, incorporated and exploited in whole or in part in any website, publication, film, video and in all media and formats now or invented after the date of these Conditions; and
- the use and reproduction of the Participant’s name, likeness, appearance and photographs, films and recordings by all means and in all media for the purpose of advertising, publicity and otherwise in relation to the exploitation and/or promotion of the Events, future events and other events held by the Organiser and/or their Collaborative Sport Partners.
- Any film, photographs, or any other recording of moving or still picture of the Participant, and all intellectual property in connection therewith (including but not limited to copyright) shall remain the property of the Organiser, and where such intellectual property does not automatically vest in the Organiser, these Conditions shall constitute a legally binding assignment thereof and/or the Participant shall sign all reasonable documentation required to give affect thereto. Accordingly, any such recording shall not be used other than for private use without the Organiser’s prior written consent.
- The Participant consents that the Organiser may retain their personal information as part of the results of the Events, share such information with Collaborative Sport Partners and/or any affiliated organisation, and use such information for future research publications. Results may include name, gender, equal opportunities monitoring data, performance scores and age category.
- General
- These Conditions constitute the entire agreement and understanding of the parties and supersede any previous agreement between the parties relating to the Programme. The Applicant acknowledges and agrees that in submitting the Entry Form it does not rely on, and shall have no remedy in respect of, any statement, representation, warranty, understanding, promise or assurance (whether negligently or innocently made) of any person (whether party to these Conditions or not) other than as expressly set out in these Conditions.
- To the extent permitted by law all provisions of these Conditions shall be severable, and no provision shall be affected by the invalidity or unenforceability of any other provision with the remaining provisions if necessary, being so amended as shall be necessary to give effect to the spirit of these Conditions so far as possible.
- These Conditions shall be interpreted in accordance with the laws of England and Wales and any dispute arising hereunder shall be subject to the exclusive jurisdiction of the English Courts.
